These Terms govern your use of the noPain website and app (the “Service”), provided by [LEGAL ENTITY NAME] (“noPain”, “we”, “us”). By using the Service you agree to them. Please read the medical disclaimer carefully — it matters.

Not medical advice. noPain provides general wellness and educational information and movement suggestions. It does not diagnose, treat, cure, or prevent any condition, and it is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider about any medical concern. If your pain is severe, sudden, or persistent, or you have a medical condition, stop and seek professional care. In an emergency, call your local emergency number.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service, and able to form a binding contract. By using noPain you confirm you meet these requirements.

2. Health & assumption of risk

Any movement or exercise carries some risk. You are responsible for using the Service safely and within your own limits. Before starting any new movement programme, consult a healthcare professional, especially if you are pregnant, recovering from injury or surgery, or have a chronic or acute condition. Stop immediately if you feel pain, dizziness, or discomfort beyond normal effort. By using the Service you acknowledge these risks and agree that you participate voluntarily and at your own risk.

3. Your account

You are responsible for the accuracy of your account information and for keeping your access credentials secure. Tell us promptly of any unauthorised use. You are responsible for activity under your account.

4. License to use

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial wellness use. You may not copy, resell, reverse-engineer, or build a competing product from the Service or its content.

5. Subscriptions & billing

noPain may offer free and paid plans, including a free trial and monthly or annual subscriptions.

Paid subscriptions are billed through the Apple App Store or Google Play and are governed by their terms; we do not process or store your payment card details.
Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before renewal, through your App Store / Google Play account settings.
If you start a free trial, any unused portion is forfeited when you purchase a subscription, where applicable.
Refunds are handled according to the policies of the App Store or Google Play through which you purchased.

6. Acceptable use

You agree not to misuse the Service — including by breaking the law, infringing others’ rights, attempting to disrupt or gain unauthorised access to our systems, scraping, or using the Service to provide medical services to others.

7. Intellectual property

The Service, including its software, design, text, the noPain and nopAIn names and marks, the anatomical figure, and the underlying methodology and content, is owned by us or our licensors and protected by intellectual-property laws. Nothing in these Terms transfers ownership to you.

8. Your content

Pain logs and other data you enter remain yours. You grant us a limited licence to process that data solely to operate and personalize the Service for you, as described in our Privacy Policy. You are responsible for the content you submit.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any suggestion will achieve a particular result. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, noPain and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service or reliance on its content. To the extent liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnification

You agree to indemnify and hold harmless noPain from claims, damages, and expenses arising out of your misuse of the Service or breach of these Terms, to the extent permitted by law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

13. Governing law & disputes

These Terms are governed by the laws of [GOVERNING LAW — e.g. State of Delaware, USA], without regard to conflict-of-law rules. Disputes will be resolved in the courts or by the dispute-resolution method specified for [JURISDICTION / ARBITRATION TERMS].
